Official Sweepstakes Rules:

1. The 2019 Swamp Base Trek 1 Giveaway (the “Promotion”) is sponsored by Louisiana Swamp Base, Inc. ("Sponsor").
2. No purchase necessary.
3. Eligibility: The Promotion is open only to persons who, at the time of entry, are (a) 18 years old or older; (b) legally reside in any state in the United States of America, except New York or Florida, or in the District of Columbia, and (c) are registered members of the Boy Scouts of America, their parents, guardians, or spouses. The Promotion is not offered in New York or Florida or elsewhere where prohibited by law. Employees, contractors, directors and officers of Boy Scouts of America (“Sponsor") and its affiliates and the advertising, fulfillment, judging and promotion agencies involved in the development and administration of this Promotion (collectively, “Promotion Parties"), and their respective immediate family members (parent, child, sibling and spouse of each) and those living in the same households of each are not eligible. Void elsewhere and where prohibited by law.
4. Promotion Period: The Promotion begins at 10:00 am Central time (“CT”), October 11, 2018, and ends at 12:00 pm CT, December 12, 2018 (the “Promotion Period”).
5. How to Enter: To enter, one must complete the survey listed below. All contestants understand & agree that the contact information collected via their Promotion entry form will be added to Swamp Base’s e-mail marketing lists if it is not already a part of said list. (Swamp Base does not sell or distribute their mailing list to third parties.) Limit one email entry allowed per person. Duplicate entries will be deleted prior to the Promotion drawing.
6. Entry Requirements: In order to be entered in the Promotion, Entrants must comply with registration instructions. Any Entry or portion thereof that is, in the Sponsor's sole discretion, obscene, profane, lewd, defamatory, contains any third party materials, or otherwise violates or infringes (or may infringe) any copyright, trademark, logo, mark that identifies a brand or other proprietary right of any person living or deceased (including but not limited to rights of privacy or publicity or portrayal in a false light) or entity, or is otherwise objectionable, will not be considered and may disqualify the Entrant.
7. Winners: One Winner will be chosen randomly on December 14, 2018 using an online random generator website, and announced via Swamp Base's Facebook and Instagram pages. The winner of the Promotion will also be notified personally via e-mail. Please check and update spam filters and allow emails from the domain scouting.org to receive notifications regarding the Promotion. In the event that a potential winner cannot be contacted within thirty (30) days of the drawing, the email is undeliverable, the email address is incorrect or any requested information is not received within the requested time period, the potential winner will be disqualified, and an alternate winner may be selected at the sole discretion of the Sponsor. Potential winner is subject to eligibility verification and compliance with these Official Rules.  Potential winner will be required to sign and return (a) an affidavit of eligibility/liability release and (b) a publicity release (except where prohibited by law) within thirty (30) days of notification attempt, or an alternate potential winner will be selected, time permitting. Should a potential winner decide to decline the prize for any reason whatsoever, Sponsor shall have no further obligation to that potential winner, and an alternate potential winner will be selected. Acceptance of the prize constitutes permission for the Sponsor and its designees to use the prize winner and designated Swamp Base trek crew participants' names, biographical information, likenesses, photographs (including, without limitation, for advertising and promotional purposes) in perpetuity, throughout the universe, in all media whether now known or hereafter devised, without additional compensation unless prohibited by law. Winners are allowed to transfer the trek to a registered Boy Scouts of America Scouts, BSA Troop, Venturing Crew, Sea Scout Ship, or Explorer Post. Winner is liable for any and all taxes related to accepting the prize.
8. All participants of the winning trek must be registered members of the Boy Scouts of America and have completed all necessary trainings, certifications and health forms prior to participating.
9. Prize & Odds of Winning: A Swamp Base Trek 1 Crew of up to 11 people, valued at up to $7,150. Prize is for trek related fees and does not include transportation, equipment, or personal gear. The winning trek must take place during the 2019 Swamp Base summer season (June 6 - July 14). Available dates at the close of the Promotion will be made known to the winner, and the winner will decide which trek date they would like to register for. The prize cannot be redeemed for its cash value or for other prizes. Odds of winning depend on the number of Entries received. Winner will be solely responsible for all taxes and other expenses related to the prize, if any. No substitutions allowed, except at the discretion of the Sponsor. Taxes, and all other expenses not specified herein, if any, are the responsibility of the winner. The winner is advised to consult with his/her tax advisors, lawyers, and/or financial advisors regarding the tax implications of the above-stated prizes. Prizes are awarded “as is” with no warranty or guarantee, either expressed or implied by Sponsor. All prize details are at the discretion of the Sponsor.
10. Marketing Communications: By entering the Promotion, Entrants agree to their name, email address and mailing address being added to Sponsor’s mailing list and to receive future promotional communications from Sponsor. Entrants may unsubscribe from Sponsor’s mailing list at any time by following the instructions contained in such communications from Sponsor or by writing to Sponsor at the address listed in Section 15 below.
11. General: Winners are required to submit an affidavit of eligibility form and release of liability and a publicity release within 30 days of attempted delivery (sent via email to winners) or prize will be forfeited. Grand prize winner has thirty (30) days to claim prize, otherwise another winner may be chosen, at Sponsor’s discretion. The return of any prize/prize notification as undeliverable or failure to return any documents in a timely manner may result in disqualification and an alternate winner may be chosen. This Promotion is not sponsored or administered by Facebook, Instagram, Twitter, or any other social media platform through which the Promotion may be advertised (collectively, “Social Media Platforms”). By participating in this Promotion, Entrants agree to release, discharge and hold harmless the Promotion Parties, all prize providers, and all Social Media Platforms from and against any and all claims, liabilities, and damages associated with this Promotion or acceptance, use or misuse of any prize received in this Promotion. Promotion Parties are not responsible for any typographical or other error in the printing of the offer or administration of the Promotion. By participating in this Promotion, Entrants agree to be bound by the Official Rules and decisions of the Sponsor, which shall be final in all matters relating to the Promotion. Promotion Parties are not responsible for lost, late, misdirected, stolen, illegible, inaccurate, damaged, incomplete, non-delivered or postage-due mail; or for printing, distribution or production errors or for technical, hardware, software, or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the user or by any of the equipment or programming associated with or utilized in this Promotion, or by any human, or other error, which may occur in this Promotion. If, in the Sponsor’s opinion, there is any suspected or actual evidence of tampering with any portion of the Promotion, or if technical difficulties compromise the integrity of the promotion, the Sponsor reserves the right to disqualify suspect Entries and/or modify or terminate the Promotion in a manner deemed reasonable by the Sponsor, in its sole discretion. In the event of a dispute regarding the identity of the person submitting an Entry, the Entry will be deemed made by the person’s name submitted at time of entry. Sponsor reserves the right to disqualify any individual who tampers with the Promotion or acts in a disruptive manner.

    The use of any automated, script, macro or robotic launching or entry software or any other mechanical or electronic means that permits a person to automatically enter repeatedly is prohibited. Any entry found or suspected to be submitted in this manner will be deemed ‘Void’ by the Sponsor. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE; THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

12. Governing Law and Jurisdiction: This Promotion is governed by United States law and is subject to all applicable federal, state and local laws and regulations. Void where prohibited. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of Entrants and Sponsor in connection with this Promotion, shall be governed by, and construed in accordance with, the laws of the State of Louisiana, U.S.A., without giving effect to the conflict of laws rules thereof, and any matters or proceedings which are not subject to arbitration as set forth in the following paragraph of these Official Rules and/or for entering any judgment on an arbitration award, shall take place in the State of Louisiana, Lafayette Parish.

    Entrants, Sponsor and any prize providers waive all rights to trial in any action or proceeding instituted in connection with these Official Rules and/or this Promotion. Any controversy or claim arising out of or relating to these Official Rules or this Promotion shall be settled by binding arbitration in accordance with the with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in the State of Louisiana, Lafayette Parish and judgment on the arbitration award may be entered into any court having jurisdiction thereof.

13. Promotion Errors: Promotion Parties assume no liability and are not responsible for, and Entrants hereby forever waive any rights to any claim in connection with, errors and/or ambiguity: (a) in the Promotion; (b) in any related advertising or promotion of this Promotion; and/or (c) in these Official Rules.  In the event of any ambiguity(s) or error(s) in these Official Rules, Sponsor reserves the right to modify these Official Rules for clarification purposes or to correct any such ambiguity or error(s) without materially affecting the terms and conditions of the Promotion.
14. Waiver: IN NO EVENT WILL THE PROMOTION PARTIES OR PRIZE PROVIDERS BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF ENTRANTS’ ACCESS TO AND PARTICIPATION IN THE PROMOTION. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO SOME ENTRANTS. ENTRANTS ARE ADVISED TO CHECK THEIR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.
